These terms and conditions help to keep this website a safe place to trade and set out the full extent of any agreement reached between you and The Derby Runner in connection with this site.You should understand that by placing an order, you accept the following terms and conditions:

The Derby Runner is a trading name of The Derby Runner Ltd a company operated and registered in the UK

Your contract for purchases made through this web site is with The Derby Runner

No contract for the sale of any product will subsist between you and The Derby Runner unless and until The Derby Runner accepts your order by way of an e-mail confirming that it has received payment in full for all the goods you have ordered, and that the goods have been shipped to the specified address.

That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time The Derby Runner sends the e-mail to you (whether or not you receive that e-mail). This confirmation (not request) e-mail amounts to an acceptance by The Derby Runner of your offer to buy goods from The Derby Runner or a 3rd party supplier that is engaged on your behalf by The Derby Runner.

You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.

The Derby Runner will not pass on your personal or credit or debit card details to any third party.

You undertake that all details you provide to The Derby Runner for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

If there are any changes to the details supplied by you it is your responsibility to inform The Derby Runner as soon as possible.

Liability

The Derby Runner does not accept liability for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services.

The Derby Runner will do its best to correct errors and omissions as quickly as practicable after being notified of them.

The Derby Runner do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the The Derby Runner website or for any products or services purchased from the The Derby Runner.

The Derby Runner will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim.

All electrical products are covered by a minimum 12 month manufacturer's warranty. If your product develops a fault whilst under warranty, please refer to our returns policy.

Processing of orders

Credit and Debit cards are debited before items are shipped by The Derby Runner. All prices include sales taxes (where applicable) unless otherwise stated.

Every purchase you make shall be deemed performed in the United Kingdom. The law of the United Kingdom shall govern every aspect of contractual agreement concerning purchases made from this web site.

The Derby Runner aim to arrange shipment of all in stock items within 24 hours of receiving your order. Your order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable and the current stock status is approximate. You can keep track of your order status yourself on-line with the order tracking facility on the 'View My Orders' page.

Delivery/Title/Risk

The period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order and stated in the Order Confirmation. Please note that your goods may be part-shipped.

Title to any product ordered will pass to you once The Derby Runner has received payment in full for that product.

If your delivery address is outside of the United Kingdom you maybe subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country;

The Derby Runner advises each customer to contact their local customs office for further information.

From time to time The Derby Runner may engage a 3rd party to fulfill orders, a contract for the sale of these products will be made between the 3rd party supplier and yourself.

Please note that when shipping products internationally you should be aware that cross-border shipments are subject to opening and inspection by customs authorities

The prices on our website do not include any local taxes that may be due on delivery to countries outside of Europe. These charges vary from country to country depending on the value of the goods shipped.

Returns

You have a right to cancel your order for any item purchased through our website with or without reason, under the distance selling regulations for refund. If you are unhappy with your purchase we accept unworn returns for replacement or refund within 30 days.

Faulty returns must be sent back for inspection before a refund will be issued. If the product is found to have a defect you will be offered a refund or exchange (if available). Refunds will ONLY be given for damaged goods where no replacement product can be supplied. Damage due to normal wear and tear, misuse, alteration to the product, or negligence is not covered under our returns policy and refund will not be given.

Returned goods must be adequately sealed in original packaging. On returning items the original packaging should also be returned undamaged and as received. This must be wrapped in an extra outer layer. Failure to do so could result in only a partial refund being issued.

SUSPECTED FAULTY SHOES SHOULD BE RETURNED CLEAN AND DRY. Shoes that come back to us in a state unfit for our staff to inspect will be kept at our premises until you can arrange for them to be picked up or until you have paid the postage to return the item to you. Please note this is a health and safety issue we take seriously.

Please ensure you ask for a certificate of posting as proof you have sent the package. Royal Mail do charge for issuing a certificate. If you return an item without proof of postage and it is lost in transit we reserve the right not to issue a refund. You are responsible for the item until we receive it. Therefore, we suggest you return the parcel using Royal Mail Tracked Delivery, or similar. We will not refund the postage paid by the customer on unwanted returned items or sizing issues (so please contact us regarding sizing prior to ordering if you are unsure).

Goods purchased mail order cannot be returned to the shop.

If you purchased from our shop

The Derby Runner are happy to exchange non-faulty products when returned within 14 days. We MAY offer a full refund within 7 days of purchase, if we genuinely cannot find a suitable product to suit your requirement. This is at our discretion*. All returns must be in original condition (unworn) with labels attached and must be accompanied by the purchase receipt.

If shoes purchased in-store are returned for refund, Video Gait Analysis charge will still apply and will not be refunded.

SALE items are non-refundable but may be exchanged.

*Electrical items such as watches are non-refundable.

Faulty electrical products - If an item is deemed faulty within 7 days The Derby Runner will inspect and deal with replacing or repairing the product. Please note that most electrical items should be charged and updated online before use. After 7 days has passed it is the responsibility of the customer to contact the service team of the electronic brand. The Derby Runner may also be able to assist with returns after 7 days. All returns at the discretion of The Derby Runner’s management.

This is in addition to your statutory rights which remain unaffected.

Miscellaneous

It is a crime to use a false name or a known invalid credit card to order.

Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.

The Derby Runner may amend these terms and conditions from time to time, and place the new version on the website. All purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms.

These terms and conditions shall apply when The Derby Runner accepts your order by e-mail confirming that it has received payment in full for all the goods you have ordered. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between The Derby Runner and you relating to your purchase. northernrunner.com advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by The Derby Runner.
